Please review these terms and conditions carefully before utilizing Our Service.

Interpretation and Definitions

Interpretation

Capitalized terms used herein possess the meanings defined below, irrespective of their usage in the singular or plural form.

Definitions

For the purposes of these Terms and Conditions:

  • Application means the software program provided by the Company downloaded by You on any electronic device, named TinGs.

  • Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) from which the Application was downloaded.

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the voting shares, equity interest, or other securities.

  • Company (referred to as "the Company," "We," "Us," or "Our") refers to TinGs.

  • Country refers to: Cameroon.

  • Device means any electronic device capable of accessing the Service, such as a computer, mobile phone, or digital tablet.

  • Service refers to the Application.

  • Terms and Conditions (also "Terms") mean these Terms and Conditions, which constitute the entire agreement between You and the Company regarding the use of the Service.

  • Third-party Social Media Service means any services or content provided by a third party that may be displayed, included, or made available by the Service.

  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service.

1. Acknowledgment and Acceptance

These Terms govern the use of the Service and establish the contractual agreement between You and the Company, outlining the rights and obligations of all users.

Your access and use of the Service is conditional upon Your acceptance of and compliance with these Terms. These Terms apply to all users, visitors, and others who access or use the Service.

By accessing or using the Service, You agree to be bound by these Terms. Should You disagree with any portion of these Terms, You must not access the Service.

You represent that You are over the age of 18. The Company prohibits those under 18 from using the Service.

Your use of the Service is also conditioned on Your acceptance of and compliance with the Company's Privacy Policy, which describes Our procedures regarding the collection, use, and disclosure of Your personal information.

2. Mandatory Safety Protocol and Physical Service Fee (Compliance)

2.1. Physical Service Requirement: Due to heightened security concerns, including incidents of kidnapping and general civil unrest, the Company enforces a Mandatory First Meetup Safety Protocol. Access to the private chat feature is contingent upon securing a Physical Meetup Spot Reservation.

2.2. External Payment for Physical Service: The initial payment made in the Application is exclusively for securing this reservation, which is classified as a physical service. Therefore, this payment is processed through an external payment system (e.g., Mobile Money) and does not utilize the Application Store's billing system.

2.3. Reservation Validity: The reservation is secured for 24 hours. You must visit a designated Company office (located in Yaoundé, Douala, or Lagos) within this 24-hour window to finalize payment for the physical spot. Failure to finalize payment results in the cancellation of the reservation and revocation of temporary chat access.

2.4. Digital Access: The temporary chat unlock is provided as a secondary, auxiliary feature accompanying the purchase of the mandatory physical reservation service.

3. Links to Other Websites

Our Service may contain links to third-party websites or services not owned or controlled by the Company.

The Company assumes no control over and no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the Company shall not be liable, directly or indirectly, for any damage or loss caused by or in connection with the use of or reliance on any such third-party content, goods, or services.

We strongly recommend that You review the terms and conditions and privacy policies of any third-party websites or services You visit.

4. Termination

We reserve the right to terminate or suspend Your access immediately, without prior notice or liability, for any reason, including, without limitation, any breach of these Terms.

Upon termination, Your right to use the Service will cease immediately.

5. Limitation of Liability

Notwithstanding any damages You might incur, the Company's and its suppliers' entire liability under any provision of these Terms, and Your exclusive remedy, shall be limited to the amount actually paid by You through the Service or 100 USD if You have not made any purchases through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of profits, data, personal injury, or business interruption) arising out of the use of or inability to use the Service.

Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages. In such cases, the liability of each party will be limited to the greatest extent permitted by law.

6. "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" with all faults and defects, without warranty of any kind. The Company disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The Company makes no warranty or representation that the Service will meet Your requirements, operate without interruption, be error-free, or that any defects will be corrected.

7. Governing Law and Disputes

The laws of the Country (Cameroon), excluding its conflicts of law rules, shall govern these Terms and Your use of the Service.

Disputes Resolution: Should You have any concern or dispute regarding the Service, You agree to first attempt to resolve the dispute informally by contacting the Company.

8. Final Provisions

Severability and Waiver: If any provision of these Terms is deemed unenforceable or invalid, that provision will be modified to achieve its objective to the fullest extent possible, and the remaining provisions will remain in effect. Failure to exercise a right or require performance shall not constitute a waiver of such right or performance.

Changes to These Terms: We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice prior to any material changes taking effect.

Safety Disclaimer Regarding Unverified Meetups: By continuing to use the Service, You acknowledge and accept that the Company will not assume responsibility for meetups conducted outside of our officially reserved and verified Physical Meetup Spots. This includes, but is not limited to, meetings conducted at night or in any location not formally secured and paid for through the Company's protocol.
